NERDS.DE GbR | SOFTWARE LICENSE AGREEMENT

Please read this document carefully before downloading or using the software. By using the software, you agree to be bound by the terms of this agreement. If you do not agree to the terms of the agreement, do not install, download or use the software. By clicking on the "Yes" or "Accept" Button, or by opening the Software package, you agree to be bound by the terms of this agreement, click "No" or "Decline" to terminate the Installation
License
=======
If you have purchased a licence to the Software Nerds.de GbR ("Nerds.de) grants you a non-exclusive right and license to use the Software and the related documentation. If you have obtained an evaluation copy to the Software, and have not purchased an ongoing license to the Software, Nerds.de grants you a non-exclusive license to use the Software free of charge for the purpose of evaluating whether you wish to purchase an ongoing license for the Software. You may use the Software on up to three computers. You may also use the Software on a second (portable or home) computer so long as only three copies are used at a time. You may make a single copy of the Software for backup and archival purposes only provided that any copy must contain all proprietary notices included in the original. You own the media on which the Software is recorded, but not the Software itself or any copy of it. This license is not a sale of the original or any copy of the Software.

Warranty Disclaimers
====================
The Software, the evaluation Software and the related documantation are provided on an "AS IS" basis, without warranty of any kind, including without limitation the warranties that the Beta Software and Evaluation Software are free of defects, merchantable, fit for a particular purpose or non-infringing. The entire risk as to the quality and performance of the Software and Evaluation Software is borne by you. Should the Software or Evaluation Software prove defective in any respect, you and not Licensor or its suppliers assume the entire cost of any service and repair.
General
=======
In no event shall nerds.de be liable to any party for direct, indirect, special, incidental, or consequential damages arising out of the use of this software and its documentation, even if the author has been advised of the possibility of such damage.
Copying, Transferring or Modifying Software
===========================================
You acknowledge that the Software contains copyrighted material, trade secrets and other proprietary information of Nerds.de and its licensors. You may not
permit concurrent use of the Software unless each user has an applicable license. Except to the extent expressly permitted by this Agreement or by the laws of the jurisdiction where you are located, you may not decompile, disassemble or otherwise reverse engineer the Software, or engage in any other activities to obtain underlying information that is not visible to the user in connection with normal use of the Software. You may not copy, transfer, transmit, sublicense or assign this license or the Software except as expressly permitted in this Agreement.

Governing Law and Interpretation
================================
This Agreement shall be interpreted under and governed by the laws of the Federal Republic of Germany. If any provision of this Agreement is held illegal or unenforceable by a court the remaining provisions of this Agreement shall remain in effect and the invalid provision deemed modified to the least degree necessary to remedy such invalidity.
TERMINATION
============
If you have purchased a license to the Software, this Agreement and license are effective from the time you accept the terms of this Agreement until this Agreement is terminated. You may terminate this Agreement at any time by destroying all copies of the Software. This Agreement will terminate immediately and without further notice if you fail to comply with any provision of this Agreement. All obligations of confidentiality and restrictions on use, and all other provisions that may reasonably be interpreted to survive termination of this Agreement, will survive termination of this Agreement for any reason. Upon termination, you agree to destroy all copies of the Software. If you have obtained an evaluation copy and evaluation Licence of the Software, and have not purchased an ongoing license to the Software, this Agreement and license are effective for a period of 30 days from the date of clicking the "Yes" or "Accept" Button.
